12 Jun Commencement of legal proceedings against the Crown in right of the State of South Australia
Further to the announcements by Global Health Limited (the Company) on 21 November 2014, 26 November 2014 and 2 April 2015 respectively, the Company advises that its wholly-owned subsidiary, Working Systems Software Pty Ltd (Working Systems), has commenced legal proceedings against the Crown in right of the State of South Australia (State), by filing originating process in the Adelaide Registry of the Federal Court of Australia.
The initiating documents for the proceedings were sealed by the Court and served on the Crown Solicitor yesterday. In the proceedings, Working Systems claims breaches of contract and infringements of copyright by the State, arising from the State’s continuing use of the CHIRON Patient Administration System software and HARMONY Financial System software (collectively, CHIRON) beyond 31 March 2015, as outlined in the Company’s above mentioned previous announcements.
Working Systems seeks relief by way of damages, declarations and a permanent injunction restraining the State from continuing to use CHIRON.
As previously announced by the Company, the South Australian Minister for Health has indicated the State’s intention to rely upon the Crown compulsory licensing regime for Commonwealth and State governments under the Copyright Act 1968 (Cth) which Working Systems contends does not apply to computer programs.
